Welcome to Dynos Media. These Terms and Conditions ("Terms", "Terms and Conditions") govern your access to and use of the Dynos Media website (the "Service") operated by Dynos Media, located in Zambia, including our offerings in internet marketing services, short courses on marketing and digital strategies, professional website designing, and online promotion activities.

By accessing or using the Service, enrolling in any short course, commissioning website design services, engaging our marketing or promotion services, or using any affiliate links and recommendations provided through our platform, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access or use the Service.

1. Use of the Service

You must be at least 18 years old or the age of majority in your jurisdiction to use our Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms. You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit their use and enjoyment of the Service.

Prohibited activities include, but are not limited to: transmitting viruses or malicious code; attempting unauthorized access to our systems; harassing or abusing other users; posting unlawful, defamatory, obscene, or infringing content; using the Service for commercial purposes without our express permission (except as explicitly allowed through affiliate programs or partnerships); or interfering with the Service's functionality.

2. Intellectual Property

The Service and its original content, features, and functionality (including but not limited to text, graphics, logos, course materials, website templates, marketing strategies shared in courses, designs, and promotional content) are and will remain the exclusive property of Dynos Media and its licensors. The Service is protected by copyright, trademark, and other laws of Zambia and international treaties.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes (or for your own business use in the case of commissioned services), subject to these Terms. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any material from the Service without our prior written consent, except as expressly permitted (e.g., downloading your purchased course materials for personal use).

For website design services, upon full payment and subject to these Terms, we grant you a non-exclusive license to use the final delivered website design for your own business purposes. We retain ownership of pre-existing tools, templates, code libraries, and any Designer Tools used in the project.

3. Short Courses and Digital Products

Our short courses on internet marketing, website designing, promotion strategies, and related digital topics are provided for educational purposes only. Enrollment in a course grants you a personal, non-transferable license to access and view the course content for your individual learning. You agree not to share your access credentials, download content for redistribution, record sessions without permission, or use the materials to create competing products or services.

Course access is typically provided for a specified period (e.g., lifetime access or a defined term as stated at purchase). We reserve the right to update, modify, or discontinue courses at any time, though purchased access will generally be honored. Refunds for digital courses are limited and subject to our refund policy outlined below. Results from applying course teachings are not guaranteed, as success depends on individual effort, market conditions, and other factors.

4. Website Designing Services

When you engage Dynos Media for website designing, a separate service agreement or proposal will outline scope, timelines, deliverables, fees, and milestones. These Terms supplement any such agreement. You agree to provide necessary content, feedback, and approvals in a timely manner. Delays caused by you may extend timelines and affect costs.

Payment terms are as specified in the proposal (e.g., deposits, milestone payments, final balance upon completion). We retain rights to preliminary works until full payment. Upon completion and full payment, you receive ownership of the final deliverables (excluding our pre-existing tools). We may include a link or credit to Dynos Media in the footer unless otherwise agreed.

Revisions are limited to a reasonable number (typically 2-3 rounds) as defined in the proposal. Additional revisions may incur extra fees.

5. Internet Marketing and Promotion Services

Our marketing and promotion services include consultations, campaign management, SEO, PPC, content creation, social media strategies, and affiliate promotions. Services are provided on a best-effort basis using industry-standard practices. We do not guarantee specific rankings, traffic volumes, leads, sales, or ROI, as these depend on external factors like search engine algorithms, competition, and audience behavior.

For affiliate links and partnerships (e.g., recommended platforms), we may earn commissions at no extra cost to you. We strive for transparency and only recommend services we believe offer value, but we are not responsible for the performance, security, or practices of third-party platforms.

6. Payments, Refunds, and Cancellations

All fees are in USD or ZMW as specified. Payments are non-refundable except as explicitly stated. For courses: limited refund window (e.g., 7-14 days) if no substantial access has occurred. For services: deposits are non-refundable; partial refunds may apply for undelivered work per agreement. We reserve the right to suspend services for non-payment.

7. Limitation of Liability

To the fullest extent permitted by law, Dynos Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunities, arising from your use of the Service, even if advised of the possibility. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses.

8. Indemnification

You agree to indemnify, defend, and hold harmless Dynos Media, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

9. Termination

We may terminate or suspend your access immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions surviving termination include intellectual property, limitation of liability, indemnification, and governing law.

10. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the Republic of Zambia, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall be resolved exclusively in the courts located in Zambia. You agree to submit to the personal jurisdiction of such courts.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service. Your continued use after changes constitutes acceptance of the new Terms.
